METALfab 2026 SPONSORS & EXHIBITORS agreement


NOMMA ADVERTISING POLICIES AND CONTRACT

To protect the interests of its members and advertisers, NOMMAA has established these policies for advertising at events sponsored by the Association. NOMMA reserves the right to decline or cancel any space reservation or position commitment at any time without cause. NOMMA reserves the right to reject advertising that makes misleading claims or that uses art or words that impugn or degrade anyone on the basis of race, color, national origin, creed, disability, age, or sexual orientation. NOMMA reserves the right to reject advertising that promotes illegal activity or activity detrimental or damaging to the Association and its mission. NOMMA supports the Better Business Bureau’s Code of Advertising. Advertisers are subject to review by the Better Business Bureau.  In consideration of NOMMA’s acceptance of such exhibits, the exhibitor agrees to indemnify and hold harmless NOMMA, its Board of Directors, and its officers, agents, and employees from and against all loss, cost, and expense, including reasonable attorney fees resulting from the publication or use of the advertisement. Submittal of advertising to NOMMA constitutes acceptance to the above policies. These policies are subject to revision.

EXHIBITOR TERMS & CONDITIONS
Through the submission of this contract for the 2026 METALfab, exhibitor and all exhibit staff agree to the following terms and conditions. Please contact the Show Management with any questions. NOMMA reserves the right to cancel a contract or deny access to the event to any exhibitor who fails to follow these rules. Note For the purposes of this document, Show Management refers to the National Ornamental & Miscellaneous Metals Association and Etherio, their officers, directors, employees, and agents. Attendee numbers for any event are not guaranteed.

EXHIBIT SPACE AGREEMENT

By submitting the agreement for exhibit space, the exhibitor releases Show Management from all liabilities to exhibitor, its agents, licensees, or employees that may arise as a result of submission of an agreement or participation in this exhibit. Acceptance of an agreement does not imply endorsement by Show Management of the exhibitor’s products, nor does rejection imply lack of merit of product or manufacturer. Show Management has the sole right to determine eligibility of any company or product for inclusion. Show Management has the right to move any exhibitor’s location within the exhibit area for any reason. Exhibitors assume full responsibility for their exhibit.  Exhibitor understands that they must work with Show Management to obtain any necessary permits and to ensure exhibit meets Fire Marshal requirements.

Outstanding NOMMA membership accounts must be paid in full before any firm shall be allowed to exhibit.


CANCELLATION POLICY

Cancellations for METALfab sponsorships and/or exhibit space must be submitted in writing to info@NOMMA.org by December 31, 2025, to receive a 50% refund of the deposit. No refunds will be granted after this deadline.


SUBLETTING OF SPACE

Exhibitors may not assign, sublet, or share any part of the space allotted to them, and may not advertise goods or services other than those manufactured or sold by them in the regular course of their business without the express written approval of Show Management.

ATTENDEE LIST

Any attendee list provided to exhibitors will exclude attendees that have opted out of sharing their contact information.

EXHIBIT SPACE

All exhibit opportunities are on a first-come, first-served basis. Show sponsors will receive first choice of location.  Decorations, signs, banners, etc., may not be taped, nailed, tacked, stapled or otherwise fastened to the permanent structure of the building. Helium balloons are not permitted within the facility.

Exhibit(s) must be arranged to avoid obstructing the general view of the other exhibits in the Show area. Exhibits must be self-contained within the booth area assigned, and chairs, furniture, or exhibit materials are NOT to be placed outside the allotted exhibit area. Demonstrations are permitted only within the confines of the individual Exhibitor’s allotted space. No interference with normal traffic flow and infringement of neighboring spaces shall be permitted. Display material exposing an unfinished surface to neighboring spaces is strictly prohibited. Nothing shall be posted, tacked, screwed, or otherwise attached to columns, walls, floors or other parts of the facility or furniture. Exhibitors may not apply paint, lacquer, adhesive, or any other coating to building walls and floors or to standard booth equipment. Exhibitor shall be liable for any damage caused by fastening displays or fixtures to building floors, walls, or to standard exhibit equipment or for damage caused in any other manner. In the event of damaged property, NOMMA reserves the right to designate the contractor for repair.  Exhibitor shall not do, nor permit anything to be done, which may interfere with the effectiveness or accessibility of utility, heating, ventilation, or air conditioning systems or portions thereof, or to the public areas adjacent thereto, or to the street or sidewalks adjoining. Any changes required to protect the facility in the opinion of NOMMA shall be at the expense of the Exhibitor. All exhibit spaces must be carpeted. Consult Exhibitor Service Manual for arrangements. Service for the cleaning of the aisles shall be provided

SET-UP AND DISMANTLE

Exhibitors are required to adhere to set-up and dismantle times set by Show Management. Exhibits shall remain fully intact until the designated dismantle time for the event.  Each exhibiting company should have a representative present at the exhibit area throughout the exhibit hours and during the set-up and dismantling of their exhibit. Additional literature, products, storage crates, or packing materials may be stored under your assigned table if there are no protruding items from the sides. Exhibitors are responsible for ensuring their area is free from any debris, etc., that could cause harm to an event attendee.

SHIPPING

Exhibitors are responsible for the shipment and delivery of equipment and material with charges to be paid by the exhibitor. Shipments should arrive no sooner than the date designated in your exhibitor manual. Exhibitors are also responsible for arranging return shipments from the hotel and will be responsible for any storage, cleaning, and shipping charges for materials left on the show floor after the conclusion of the event.

SECURITY

Show Management, Etherio, and the host hotel are not responsible for items taken from the exhibit spaces. We highly recommend your personnel remove all personal and valuable items such as laptops, etc., from your exhibit space each evening.

EXHIBITOR REGISTRATION/PERSONNEL

All exhibitor representatives must register online prior to the METALfab to receive a badge to gain access to the exhibit area and other METALfab activities. Your exhibit package provides you with two (2) full registrations for METALfab.  Additional personnel may be registered for $50.00 per person. Set-Up Only Passes are provided at no additional cost.

EXHIBITOR REPRESENTATIVES’ RESPONSIBILITIES

Each exhibitor must name at least one person to be their representative in connection with installation, operation, and removal of the exhibit. Such representatives shall be authorized to enter into such service contracts as may be necessary and for which the Exhibitor shall be responsible.

INSURANCE

It is recommended that exhibitors maintain at its cost reasonable levels of the following types of insurance general liability (for which $1,000,000 shall be deemed the minimum reasonable level), workers compensation liability, and, if appropriate to the services rendered, automobile liability (including bodily injury and property damage), naming NOMMA, the venue, and Etherio as additional insureds. The limits of such policies do not limit Exhibitor’s liability to NOMMA or the additional insureds. Proof of insurance may be required by the host hotel.

FORCE MAJEURE

The performance of the Agreement is subject to any  circumstances making it illegal or impossible to provide  services or use hotel facilities, including Acts of God, war  government regulations, disaster, strikes (except neither  party may terminate or suspend this Agreement for strikes,  labor disputes or work stoppages involving their respective  employees or agents), civil disorder, pandemic, or  curtailment of transportation facilities. This Agreement may be terminated for any one of the above reasons by written notice from one party to the other.

INDEMNITY

Exhibitor agrees to indemnify and hold harmless Show Management, other venues, and employees or agents, for any claims arising out of the acts or negligence of the exhibitor, his agents, or employees, or out of labor disputes.  Exhibitor further agrees to assume all risk and indemnity and hold harmless Show agents and employees of each of these entities and claims, liability expenses and damages of any kind or nature arising out of or in connection with damage to or loss of any property belonging to exhibitor or exhibitor’s employees, agents, contractors, representatives, patrons and/or guests.

EXHIBITOR SERVICE MANUAL

Exhibitor Service Manuals shall be available online approximately three (3) months prior to the Show. The Exhibitor Service Manual shall contain information integral to participation at METALfab, including, but not limited to, additional Exhibitor and display rules and regulations, procedures, exhibit and Show schedule, registration, official service contractor order forms, security, plants, shipping and drayage, utilities, and Exhibit Facility services.

CHARACTER OF DISPLAYS

Distribution of samples and printed matter of any kind, or any promotional material, is restricted to the confines of the exhibit booth. No noise makers or anything not in keeping with the technical character and high standards of NOMMA may be distributed or utilized by an Exhibitor in the exhibit area.

OBJECTIONABLE DISPLAYS

NOMMA reserves the right to reject or terminate exhibit privileges of any Exhibitor including personnel in whole or in part, which because of notice, conduct of personnel, method of operation, materials, violations of Show rules, or for other causes  which NOMMA believes are not compatible with the purpose of the Show, or any other reason  in the opinion of NOMMA, without liability for any refunds or other expenses incurred. If cause is not given, liability shall not exceed the refund to the Exhibitor of the amount of rental unearned at the time of ejection. If an exhibit or Exhibitor is ejected for violation of these rules or for any other stated reason, NOMMA shall have no liability for any refund or other expenses incurred.

DRESS OF EXHIBITORS

Exhibitors should be appropriately dressed in casual business attire. Costumes not regularly associated with the business and professional character of the Show must have the express written approval of NOMMA.

HOSPITALITY FUNCTIONS/OUTSIDE EXHIBITS

Without express written approval of NOMMA, Exhibitors are prohibited from scheduling private functions, cocktail parties, special events or other hospitality functions during official Show hours or during hours when an NOMMA activity is being held. Exhibitors shall not display products/services and/or other advertising material in areas outside their exhibit space including, but not limited to, parking lots, hotel lobbies, lounges, and corridors, without express written approval from NOMMA. Unauthorized facility tours are also prohibited.

SMOKING

Smoking is not allowed in the Exhibit space.

ALCOHOLIC BEVERAGES

Exhibitors shall not be permitted to sell, serve, or give away alcoholic beverages in the Exhibit Facility without the express written approval of NOMMA.

COMPLIANCE WITH LAWS – Exhibitor shall be solely responsible for obtaining any and all necessary licenses and permits. Exhibitors shall bear responsibility for compliance with any and all local, city, state and federal safety, fire and health laws, ordinances and regulations, including, but not limited to the Policies, Rules and Regulations of the Exhibit Facility, regarding the installation, dismantle and operation of the exhibit. This information is included in the Exhibitor Service Manual.

AMERICANS WITH DISABILITIES ACT

Exhibitor represents and warrants that its exhibit and product/service information shall comply with the Americans with Disabilities Act, its regulations and guidelines (collectively “ADA”). Exhibitor shall indemnify, defend and hold harmless NOMMA, its directors, officers, agents, and representatives from and against any and all claims and expenses, including attorney’s fees and costs, arising out of or related to Exhibitor’s breach of this provision or noncompliance with any provision of the ADA. 19) UNION RULES – Exhibitors shall bear responsibility for compliance with any and all applicable union labor work rules, as listed in the Exhibitor Service Manual.

PHOTOGRAPHY

Exhibitor, its employees or agents, and attendees are not allowed to bring camera or video equipment into any part of the Show area. Exhibitors or attendees wishing to take any photographs must obtain prior written permission from NOMMA. Disregard for this Rule shall constitute cause for IMMEDIATE expulsion from the Show and Exhibitor or attendee shall forfeit all fees paid to NOMMA.

CONTENT

Exhibitor acknowledges and agrees that NOMMA, in its sole discretion, reserves the right to change any and all aspects of the Show, including but not limited to, the event name, themes, content, program, speakers, performers, hosts, moderators, venue, and time. Show content may be recorded by NOMMA and will be accessible online. By offering content in connection  with the Show, including the use of Exhibitor’s name and logo, Exhibitor grants, and represents  and warrants that Exhibitor has the right to grant to NOMMA's a non-exclusive, perpetual, irrevocable,  sub-licensable (through multiple tiers), assignable, fully-paid, royalty-free, and worldwide license  to use, copy, modify, adapt, publish, make, sell, publicly display, create derivative works of or  incorporate into other works all of such content (in whole or in part), including Exhibitor’s name  and logo; communicate to the public, distribute (through multiple tiers), perform or display all  of such content (in whole or in part), including Exhibitor’s name and logo, in any form, media,  or technology now known or later developed; and to grant and authorize sublicenses of the  foregoing through multiple tiers of sub-licensees, including the right to exercise the copyright,  publicity, and any other rights over any of the materials contained in all of such content for any  purpose, including without limitation (a) for purposes of advertising and publicity and (b) otherwise commercial or otherwise, of any of such content, and Exhibitor hereby waives any approval rights  to such content. NOMMA reserves the express right to incorporate any such content into any further work, in any medium now or hereafter known, without prior consent or review, and without prior consent or review, and without attribution or payment of any royalty or fee whatsoever. Necessary to ensure the health and safety of those in attendance, the Exhibitors, the significance of the Show, and the harmony of operation. Exhibitors shall be advised of any such changes by written bulletin, and such changes shall be binding. If there is any conflict between this Contract and any subsequent rule changes made by written bulletin, the written bulletin shall control

CHANGES

NOMMA reserves the right to make any reasonable changes in the rules necessary to ensure the health and safety of those in attendance, the Exhibitors, the significance of the Show, and the harmony of operation. Exhibitors shall be advised of any such changes by written bulletin, and such changes shall be binding. If there is any conflict between this Contract and any subsequent rule changes made by written bulletin, the written bulletin shall control.
